What is Simplified Divorce?

Am I Eligible for Simplified Divorce?

You will be eligible for a Simplified Procedure divorce provided:
·       You are seeking divorce on the grounds of non-cohabitation
·       There are no children under 16 involved
·       There are no claims for financial provision

If you do not meet all of the above criteria for a simplified divorce, you will need to pursue divorce under Ordinary Procedure. For more information, click here.

How Long Does a Simplified Procedure Divorce Take?

A Simplified Divorce Procedure can be carried out in as little as 4-6 weeks, provided you meet all of the relevant criteria mentioned above.

How Long Do You Need to be Separated?

You need to have been separated for at least a year, provided your spouse/civil partner have given consent. If they refuse consent, you need to have been separated for at least two years.

This does not necessarily mean living in separate households, as many couples cannot do so for financial or childcare related reasons. However, it does mean you have not been living together as ‘man and wife’ or civil partners.
