What is Power of Attorney?

Power of Attorney is governed by the Adults with Incapacity (Scotland) Act 2000, and the process for establishing Power of Attorney is relatively straight forward. The document sets out your wishes and the issues that may arise that will require a decision in regards to your personal wellbeing and/or finances in the event you lose capacity.

Power of Attorney prescribes various powers that include: Continuing powers; these relate to the management of your finances and Welfare Powers; matters relating to your personal wellbeing, usually decisions that are to be made on a daily basis but also including medical decisions.

What is the Registration Process?

Registration is completed by the Public Guardian office in Scotland. We will draft the documentation, ensuring your wishes are clearly set out, while also clarifying that the individuals involved understand the nature and extent of the document. We will then establish that the person granting power of Attorney is not under any undue influence and the final step, is to register Power of Attorney with the Office of Public Guardian who issue a certificate of registration.
