Am I eligible for a Simplified Divorce? 

In order to proceed with this type of divorce, you must meet the following criteria: 

  1. Your marriage must have broken down irretrievably.

  2. You cannot have any children under the age of 16.

  3. You must have ceased cohabiting with your spouse for one year or more and have their consent or; have ceased cohabiting with your spouse for more than two years.

  4. There can be no dispute in relation to financial matters.

  5. The divorce cannot be defended by your spouse.

How Much Does it Cost?

We are able to offer a Fixed Fee for Quick Divorces. We charge a total of £375 + VAT & Outlays split into two payments. The first payment is £170 + VAT and covers a detailed meeting, which can take place in person, by video call or over the phone. This meeting is essential to advise you of both your eligibility for a Quick Divorce and also to ensure your understanding of the legal process and consequences. Once we’ve confirmed everything is in order, we charge a second payment of £192 + VAT for processing your Divorce through Court. Your Divorce application is dealt with by an experienced Solicitor or Trainee Solicitor at all times guaranteeing the progress is as smooth as possible. How Long Does a Simplified Divorce Take?

The time until your divorce is granted by the Courts can sometimes vary depending on successful service of papers on your spouse and on how busy the Courts are.

Generally speaking, divorces take between 8-12 weeks to process but can take longer at certain times of the year.

What is the Procedure?

The first step is to get in touch with one of our teams in Glasgow or Aberdeen, we’ll have one of our Solicitors make sure that you are eligible and advise you specifically on your circumstances free of charge.

Following that discussion should you wish to proceed, we will open a file for you and get things moving immediately. We will complete the appropriate application on your behalf and have this signed by you. You must also complete a statement or affidavit, which is signed by a Notary Public. Again we will take care of this for you.

Thereafter the application is submitted to the Court; they then attempt to serve copies of the application on your spouse by Royal Mail. Your spouse will have to sign a form of consent if you have been separated for less than two years.

In the event you have been living apart for more than two years, your spouse does not require to do anything.

The Court will wait for 21 days from the date of service to give the opportunity for any opposition or defence to be lodged. Should this time elapse without opposition being lodged, your Divorce will then be processed.

If the Sheriff is happy with the content of the application, your Divorce will then be granted.
